Please read these Terms and Conditions carefully as they contain important information about the legal rights and obligations for the purchase, redemption, transfer, and use (“Use”) of Gift Cards by a person (“You”). By Using a Gift Card, You agree to comply with and be bound by the terms set forth herein. We reserve the right to change these Terms and Conditions without notice, from time to time at our sole discretion.

1. General.

Gift cards are issued and managed by ToursByLocals Canada Inc., located at Suite 500 - #1682, 997 Seymour St., Vancouver, British Columbia, Canada V6B 3M1 (“We” or “ToursByLocals”) and are available in electronic format only. Use of a Gift Card is governed by the laws of the Province of British Columbia, Canada.

All Gift Cards have a number that identify them (“Gift Card Number”). In order to Use your Gift Card, You will have to provide the Gift Card Number at the checkout process. Gift Cards are not associated with any user and can be Used by whoever has the Gift Card Number. Gift Cards can be Used until the remaining balance is $0.

There are no fees associated with the Use of Gift Cards.

Gift Cards are non-commissionable. Therefore, travel agents and affiliates will not receive any commission, payment and/or compensation for the selling and/or Use of Gift Cards.

2. Delivery, Loss and Unauthorized Use.

The Gift Card will be sent to the chosen recipient’s email address within 5 business days from the date of order. We will not be liable for any failure or delay in delivery or for any error in the recipient’s email address informed by You.

Neither ToursByLocals nor its affiliates is responsible for any lost or stolen Gift Cards and/or use without your permission. Please keep the Gift Card and the Gift Card Number confidential and do not disclose it.

3. How Can I Use a Gift Card?

Please consider that Gift Cards: (a) may only be redeemed toward the purchase of sightseeing tours offered at www.toursbylocals.com; (b) may not be redeemed toward the purchase of the “24 Hour Any Reason” cancellation option set forth in ToursByLocals’ Cancellation Policy; (c) are not reloadable; (d) cannot be used to purchase other Gift Cards; (e) cannot be redeemed for cash or returned for a cash refund (except as required by law). (f) are not for resale.

In case We issue a refund for a sightseeing tour purchased with a Gift Card, the remaining balance of such Gift Card will be increased up to the amount of the refund. If the tour was partially paid with a Gift Card, the refund will be issued according to the payment method used for purchase.

4. Balance.

Additional payment will be required if the purchase price of the sightseeing tour exceeds the value of the Gift Card or its remaining balance.

5. Limitation of Liability.

TO THE FULL EXTENT PERMISSIBLE BY LAW, TOURSBYLOCALS MAKES NO WARRANTY OR REPRESENTATION OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT, QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO GIFT CARDS. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN NO EVENT SHALL TOURSBYLOCALS’ LIABILITY TO YOU OR ANY OTHER PERSON ARISING OUT OF OR IN CONNECTION WITH THIS TERMS AND CONDITIONS EXCEED, IN THE AGGREGATE, THE VALUE OF THE GIFT CARD’S BALANCE WITH RESPECT TO WHICH SUCH LIABILITY RELATES OR IN THE CASE OF ANY LIABILITY NOT RELATED TO A PARTICULAR GIFT CARD, ONE HUNDRED U.S. DOLLARS (US$100). THE LIMITATIONS IN THIS SECTION SHALL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY IN THIS TERMS AND CONDITIONS IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.

We will only collect and use personal information from you in accordance with our Privacy Policy.
